A Patent For Podcasting?

In this episode, I share some shocking news in the world of podcasting. There has been a story posted that states that a Californian company receives patent for Podcasting.

I share what this article says, the response from the company who has been awarded the patent in question, and my thoughts on the whole thing.

I think the main thing to take away from this episode is that this isn’t anything we should be losing sleep over just yet. We’ll keep our eye on this story.

Will,

Thanks a bunch for the links.

Yeah, I still feel strongly that this isn't anything to lose sleep over. But at the same time, for someone who makes a career of podcasting, it's not something I'm going to ignore either.

I appreciate you placing additional information for review!

Hey Cliff, thanks for sharing this with your listeners.

Here is an Intellectual Property lawyers response to the patent: http://www.downloadablemedia.org/index.php/fear-an...

Also, I don't recall if you referenced this article in your podcast. It is Volomedia responding to questions posted by ADM and others: http://www.downloadablemedia.org/index.php/volomed...

I'm hoping that nothing major comes of this, but as you mentioned, they do want to influence podcasting standards. Time will only tell though.

Very interesting. Though, currently, the pc is the mechanism to put it on the device. We'll see how it all plays out. If you hear of any "push" on their end to enforce their patent, please do let me know.

The reason I find this patent troublesome is because intellectual property can be sold or transferred to a company that is not as favorable to the industry as VoloMedia proclaims themselves to be.

However, I believe there isn't too much to worry about based on the diagram of the process they have patented in the patent description itself.

If you look at the diagram displayed in the patent found at the link below:

http://www.uspto.gov/web/patents/patog/week30/OG/h...

The process they patented includes the use of a PC to download the media first and then send it to a portable device. I believe the natural evolution of podcasting will be to bybass the PC and directly download the media to a mobile device.

I'm not a patent lawyer but at first glance it looks like direct downloads to a mobile device should NOT be covered by this patent, based on their diagram in the patent itself.
